2 - Language

3 - Who is the website aimed at?

4 - Product Features

The features, including the name and price, of the Products are described in the sheets published on the Site. The name of the Product and its price are recalled in the order summary.

The Product sheets on the Site contain the description of the Product, the ingredients contained in the Product, the allergens of the Product, and additional information. Some of this information may not be provided if it is not relevant to a Product or not communicated by the Bretzel & Matcha supplier. Bretzel & Matcha cannot be held responsible if the ingredients or allergens are incomplete in the Product sheet.

The choice of the Product that goes into the cart and thus into the Client's order is solely the responsibility of the Client. The Client is the only one capable of determining whether the Products they order meet their needs. Bretzel & Matcha cannot be held responsible if the Product(s) purchased by the Client do not meet their needs.

5 - Product Prices and Discounts

The prices of the Products are indicated on the Site in Euros, including all taxes, but excluding the cost of delivery or the shipping cost by a carrier.

Discounts may be displayed on certain Products. These discounts are time-limited and subject to available stock, with no restocking during the discount period.

6 - Online Ordering Process

The ordering process includes the following steps.

• The Client selects the Product they wish to add to their virtual cart.

• The Customer accesses their virtual cart.

• The Client is invited to create a customer account or to log into their customer account if they already have one.

• When creating their customer account, the Customer fills out a form containing the necessary information for their identification for the processing of their order and delivery: title, first name, last name, postal address, delivery address, phone number, email address.

• The Client accesses the summary of their order. They are invited to review their order in order to identify any errors that may have occurred during data entry. The Client can modify their order and correct any potential mistakes.

• The Client chooses the delivery methods according to the carriers proposed by Bretzel & Matcha. They are informed of the delivery costs and the type of delivery.

The Client validates the General Terms and Conditions.

The Client confirms their order by clicking on the button provided for this purpose.

The Customer is invited to choose their payment method and then proceed to make the payment online on a secure page for the total amount of their order.

The company Bretzel & Matcha is informed of the payment, and the Client receives a receipt for their payment.

The order is confirmed when Bretzel & Matcha receives the payment from the Customer.

Bretzel & Matcha acknowledges receipt of the order by sending the customer an email that includes a copy of the order.

7 - Payment methods

The following payment methods are offered on the Site: credit card (CB and Visa from the European Economic Area) with Stripe, Apple Pay.

Stripe is an international platform used by millions of businesses worldwide, ensuring great reliability and a proven service. Additionally, Stripe employs high security standards for payment processing, including PCI DSS Level 1 compliance, which means that the payment information of Bretzel & Matcha's customers is protected.

Bretzel & Matcha cannot access its customers' payment method data.

8 - Order rejection

Bretzel & Matcha reserves the right to refuse any order for Products, even if the order has been validated and paid for by the Customer, for legitimate reasons such as

- Abnormal demand: for example, excessive quantity of sales.

- Unavailability or out of stock

- Inappropriate consumer behavior

- Legal prohibitions such as, for example, refusing to sell alcohol to a minor.

 The Client will be informed as soon as possible, and if the order has been paid for by the Client, Bretzel & Matcha will proceed with the refund of the amounts paid by the Client for the order refused by Bretzel & Matcha. This refund will occur within a period of 14 days and according to the payment method used by the Client for this order.

9 - Product Availability

The products offered for sale are subject to availability.

However, if a Product ordered by the Client is no longer available, Bretzel & Matcha agrees to inform the Client as soon as possible.

Bretzel & Matcha may offer the Customer a replacement Product of equivalent price. If there is no replacement Product available or if the Customer does not wish to receive the replacement Product, the Customer may either cancel the part of their order related to the unavailable Product or wait for the restocking of that unavailable Product at Bretzel & Matcha in order to receive it in another shipment without any additional shipping or delivery fees.

If the Customer chooses to cancel this part of their order, Bretzel & Matcha will proceed to refund the unavailable Product within fourteen days from the day the Customer opted to cancel this part of their order. The shipping or delivery costs will also be refunded within the same timeframe if the unavailable Product was the only item in the order. The refund will be made using the same method that the Customer used to pay for their order.

10 - Delivery and Deadlines

Delivery fees depend on the delivery location specified by the Customer at the time of their order, the weight of their order, and the chosen carrier. The amount of these fees and the delivery time are indicated to the Customer before the final validation of their order and payment.

For the Customer who wishes to have delivery to an address with the postal code 67120, and only for this postal code, they must place their order by 10 PM at the latest, the day before the working day of delivery. They will be delivered on the first working day (Monday to Friday, excluding public holidays) following the day of their order between 9 AM and noon, as far as possible.

For the Client who indicated a delivery address with the postal code 67120, the delivery will be carried out by Bretzel & Matcha to this same address between 9 AM and noon, as stated in the previous paragraph, without prior notice. However, if Bretzel & Matcha should experience a delay in the delivery, the client will be notified to confirm the delivery at a new time or to reschedule it for a date of their choice, at no additional cost to the Client and without compensation for the Client given the reduced price of the delivery for this postal code.

The deadlines indicated by Bretzel & Matcha start from the payment of the order and the sending of the order confirmation email.

For all other Customers (those who do not have the postal code 67120), delivery will be ensured at a pickup point (Chronopost or Mondial Relay). The Customer will be notified by the carrier of the arrival of their package via email to the address provided by the Customer when placing their order.

Bretzel & Matcha strives as much as possible to meet the order preparation time commitments to its Clients. However, Bretzel & Matcha cannot be held responsible if the delay is due to a failure in its own supply from its suppliers or due to a failure of the carriers.

11 - Order Reception

For the Customer who has provided a delivery address with the postal code 67120, in the event of the Customer's absence at the time of delivery, Bretzel & Matcha will do its best to ensure that the delivery is left, unless contrary instructions are given by the Customer at the time of their order. In this case, Bretzel & Matcha cannot be held responsible if the Customer does not collect their order. If it is not possible to leave the order due to the customer's absence, Bretzel & Matcha will proceed with the cancellation of the order and the refund of the order excluding delivery fees, within 14 days following the initially scheduled delivery date, and according to the payment method used by the Customer to pay for their order.

For customers from other postal codes, the customer is required to collect the order at the relay point they specified on the Site when placing their order. This relay point must be in mainland France (including Corsica and coastal islands, excluding overseas departments and territories). If the customer indicated a relay point outside of mainland France (including Corsica and coastal islands, excluding overseas departments and territories), Bretzel & Matcha will reject the order. See the section "Order Rejection" for more information.

The return of the Client's order to Bretzel & Matcha because the Client did not pick up their order within the allotted time will result in the cancellation of the order. The Client will be refunded the amount of the products contained in this order; however, the amount of the shipping fees originally paid by the Client for delivery to a pickup point will not be refunded. Regarding the return fees charged to Bretzel & Matcha for this uncollected order, they will be fully deducted from the amount of the products returned to Bretzel & Matcha. The Client will thus receive the amount of the products from their order, minus the return fees to Bretzel & Matcha for this uncollected order, within a maximum of 14 days from the return date to Bretzel & Matcha and according to the payment method used by the Client to settle their order. Following the refund, the order will be considered completed. If the Client wishes to purchase these products, they must place a new order and bear the costs associated with this new order.

12 - Right of withdrawal

In accordance with the law (Article L221-18 of the Consumer Code), the Customer has a period of 14 days from the delivery of their order to inform Bretzel & Matcha in writing at the headquarters address of Bretzel & Matcha (see the section Presentation of the site and the company), of their intention to withdraw and to return the Product, unopened and in its original packaging, at their own expense.

Bretzel & Matcha will reimburse the Customer for the total amount paid for the returned Product(s), excluding delivery charges and return fees, within 14 days from the receipt of the returned Product(s), using the same payment method used by the Customer to originally pay for their order.

13 - Legal warranty

The Client benefits from the legal warranty of conformity, in accordance with articles L. 217-4 and following of the Consumer Code. They also benefit from the warranty for defects in the sold item under the conditions provided for in articles 1641 to 1648 and 2232 of the Civil Code. To exercise these warranties, the consumer is invited to contact the company BRETZEL & MATCHA in writing at the address of the registered office in the "Presentation of the site and the company" section.

14 - Handling of Complaints

In the event of a damaged order received, the Customer must keep all original packaging of the Products received and take all necessary photos showing the extent of the damage. The Customer must contact Bretzel & Matcha by email as indicated in the paragraph "Site and Company Presentation," with the subject: "Damaged Order," describing the damage incurred and attaching the taken photos. Bretzel & Matcha will contact the Customer within 2 business days to find an appropriate solution.

For all other claims, the Client must send them to the company BRETZEL & MATCHA by postal mail to the registered office address indicated in the paragraph "Presentation of the site and the company." The company will make every effort to address these claims as quickly as possible and provide an appropriate response.

15 - Dispute resolution - Use of consumer mediation.

In the case of a manifest dispute, the Client must necessarily get in touch with Bretzel & Matcha in writing to try to resolve the dispute.

If the disagreement persists, the Client can then contact the consumer mediator by providing a file that includes the complaint letter addressed toBretzel & Matcha, as well as all supporting documents.

16 - Responsibility of Bretzel & Matcha

The liability of Bretzel & Matcha shall not be engaged in any case of total or partial non-performance of an order when such non-performance results from one of the following cases:

• Client's Responsibility: Any error, omission, or negligence on the part of the Client, particularly regarding the provision of incorrect or incomplete information, or the failure to comply with the instructions specified during the order placement, exempts Bretzel & Matcha from any liability in the event of failure or malfunction.

• Insurmountable and unpredictable event caused by a third party to the contract: Conditions or events beyond the control of Bretzel & Matcha, such as external service providers, suppliers, or other participants whose actions are necessary for the execution of the order, which cannot be anticipated or avoided despite all reasonable diligence.

• Force majeure: Any event beyond the control of Bretzel & Matcha, irresistible and unpredictable, that makes it impossible to fulfill the contract under normal conditions. Examples include, but are not limited to: flooding, storm, fire, earthquake, pandemic, act of terrorism, war, national or local strike, natural disaster, shortage of raw materials or energy, regulations or administrative decisions, as well as any other event considered a case of force majeure by jurisprudence.

The liability of Bretzel & Matcha can only be held for actions that are directly attributable to it, that is to say those resulting from a deliberate breach or gross negligence on its part, and which have caused it direct, quantifiable, and proven harm.

Furthermore, Bretzel & Matcha disclaims any responsibility regarding the suitability or use of the Product for a specific purpose sought by the Client, if this use has not been expressly stated at the time of the order, nor accepted in advance by Bretzel & Matcha. Consequently, any warranty or liability related to a particular use of the Product, which is solely in the interest of the Client, is excluded.

In addition, Bretzel & Matcha cannot be held liable for any inconveniences, losses, or indirect damages, such as:

• The loss or corruption of computer data or files,

• The disruption or interruption of Internet service,

• The intrusion or external attack,

• The presence of viruses or malware,

• Any other inconvenience related to the use of the network or service interruptions.

Finally, it is expressly agreed that the liability of Bretzel & Matcha is completely excluded in the event of a force majeure occurrence, defined as any unforeseen, irresistible event that is independent of their will and makes the normal execution of the contract impossible. Among these events, the following can be mentioned:

• Floods, storms, earthquakes, or other natural disasters,

• The spread of pandemics or epidemics,

• Strikes or social movements,

• The shortage or disruption of supply of raw materials or energy,

• Decisions or regulations issued by public authorities,

• War, civil war or any violent event such as attacks...

• And, more generally, any event or circumstance beyond the reasonable control of Bretzel & Matcha, in accordance with the law, case law, and common practice.

In any case, Bretzel & Matcha shall not be held liable for indirect damages, loss of profits, loss of business, or any other harm beyond its control, arising directly or indirectly from the performance or non-performance of the contract with its clients.

17 - Protection of personal data

All personal data provided by the Client (first name, last name, postal address, email, phone number, delivery address) will be considered confidential. This information, necessary for managing the order and/or creating the client account, will be subject to computer processing and may be communicated to third-party companies as part of the order management.
